Keep in mind the judge can impose a concurrent rather than consecutive sentence. In essence this means you serve the sentence of the lesser charges at the same time as the worst charges.

Given a lack of a criminal record for Chauvin, he will be sentenced to the lower level of jail time, maybe 12-15 years. Take off time served and good time credits once incarcerated, he could be free in 6 years.

Google Sammy Yatim, Toronto kid who was shot 8 times by a cop on an empty bus holding a pen knife. Cop was found guilty, but of a lesser charge than murder, they ruled his second “ volley” of shots was unnecessary.....yeah, like the first 5 shots needed to be fired, the other dozen cops had their guns holstered.

Come to think of it, very similar to Floyd’s death, in that bystanders phone footage was used and broadcast right away for all to see- no bodycams yet in 2013 in Toronto. And both men were on serious drugs
 

There were protests I believe, but no looting or unrest. I guess an 18 year old Syrian kid’s death is not worth burning buildings over, but George Floyd was

Two things that called this deal early, weeks ago.

1. The vivid video that is just repulsive to view for even hardcore experienced folks.

2. Strong convincing testimony from other cop administrators, training specialist, and front line patrolmen who testified that that kind of shit is just not done, period. No way Jose.

The guy was toast from that point on. Forget all the other stuff, all fluff. Anything presented at the trial is just attempt to present some kind of relief for his sentencing. 

I'm not sure who paid for his defense... Whether his union did or not..??? In my opinion the union should have told him to f**k off.

I believe that his defence was paid for by the MPPOA, the Minnesota Police and Peace Officers Association.

Agreed. This trial was over early on. Believe what you see. It's really that simple.

Biden and Rep Omar said the white cop was guilty before verdict was delivered despite judge warning Dems to STOP talking about case

  • Democrats repeatedly enraged Judge Peter Cahill with their comments about the Derek Chauvin trial 
  • Chauvin's attorney Eric Nelson cited the comments in multiple bids to have the trial delayed and for Cahill to declare a mistrial 
  • The trouble began with Minneapolis officials announcing the city's $27million settlement with the Floyd family in the middle of jury selection
  • It was the result of a separate, civil case in a different court that was resolved on March 18 
  • Cahill didn't want it brought into his trial. He demanded: 'Everyone just needs to stop talking about [the settlement]' 
  • Rep Maxine Waters drew outrage when the jury was sent out after she called for BLM protesters to 'get more confrontational' if Chauvin is found not guilty
  • Cahill told the defense: 'Congresswoman Waters may have given you something on appeal that may result in this whole trial being overturned'
  • The judge called it 'abhorrent' that lawmakers keep talking about the case 
  • President Joe Biden called the evidence against Chauvin 'overwhelming' on Tuesday just hours before the jury delivered its verdict
  • Ilhan Omar also spoke out before the verdict was delivered calling it a 'closed case' 

Democrats repeatedly threatened to derail Derek Chauvin's murder trial by ignoring the judge's order to stop talking about it because their comments could influence the jury. 

Chauvin was found guilty on Tuesday on all three charges - second-degree unintentional murder, third-degree murder and second-degree manslaughter - in the death of George Floyd. He now faces up to 40 years behind bars.

Chauvin's defense attorney Eric Nelson asked Judge Cahill multiple times to delay the case and declare a mistrial due to remarks from liberal politicians who presumed the defendant's guilt and stoked fears of violence after the verdict. 

Just hours before the verdict was announced, President Joe Biden joined fellow Democrats in defying Judge Peter Cahill when he called the evidence against Chauvin 'overwhelming' and said he hoped the jury would come to the 'right verdict'. 

Officials in Minneapolis drew the ire of the judge before the trial even began when they announced the city's $27million settlement with George Floyd's family in the middle of jury selection. 

Cahill was considering a defense bid to delay the trial over concerns that the 'unfortunate' timing of the settlement announcement could taint the jurors' perception of the case when officials went against the judge's wishes and held a second press conference on the issue. 

In a biting rebuke, Cahill demanded that the city, the prosecution and the defense 'stop talking about it' before ruling that the trial would proceed as schedule. 

However he was forced to dismiss two already-seated jurors and several prospective jurors who admitted that their knowledge of the settlement could prevent them from being impartial.  

As the trial neared its conclusion Congresswoman Maxine Waters enraged Cahill when she urged Black Lives Matter protesters to 'get more confrontational' if Chauvin is found not guilty.  

Chauvin's attorney cited Waters' comments when he called for a mistrial after the jury was sent out for deliberation on April 19. 

Nelson said he believed the media frenzy around the case would undoubtedly bias the jury, adding: 'Now that we have US representatives threatening acts of violence in relation to this trial it's frankly mind-blowing.'

Judge Cahill called it 'abhorrent' that politicians ignored his warnings against speaking out the case and said Waters 'may have given [the defense] something on appeal that may result in this whole trial being overturned'.

The judge ultimately denied Nelson's bid for a mistrial and the jury proceeded with deliberation. 

Rep Ilhan Omar followed President Biden's lead in speaking out hours before jurors delivered their verdict and called it a 'closed case' on Tuesday while they were still deliberating. 

President Joe Biden calls evidence against Chauvin 'overwhelming' and tells Floyd's brother Philonise he's 'praying everything comes out okay' after jury is sent out

President Joe Biden joined fellow Democrats in calling for Chauvin to be convicted on April 20 when he said the evidence against the former cop was 'overwhelming' and that he hopes the jury reaches the 'right verdict'. 

'I'm praying the verdict is the right verdict. The evidence is overwhelming in my view,' Biden told reporters in the Oval Office.

 

Plenty of grounds for appeal in my view.  With all the above in the background I doubt a fair trial was possible.  Hindsight is a wonderful thing, but would the defendant have been better having elected trial by a judge sitting without a jury?

I don't think so. The judge will determine the sentence anyway so what difference will it make?

Glad to see Chauvin get convicted, no one on this planet could reasonably say all of what he did was " reasonable" force under the circumstances. Hard to imagine that this guy after knowing full well, looking up multiple times seeing people video taping this, that he could make a case he was right. 

Well.....there are some good Police, let's give a shout out to Fremont Motorcycle Office Burch here in Calif. Damn, textbook body cam video, good to see he has " pared" the gene pool going forward huh? Good Morning, Good Afternoon and Good Night to this ass-wipe Felon. This happened last month here, love seeing this. 

I have a reservation May 17th to shoot my Glock here, might want to have this guy around to give me some pointers. Wifey is not so sure she wants to shoot the pistol though.

This police intervention is already being compared to the death of George Floyd and authorities fear it may touch off new rioting.  The heavy girl with the knife is actually 16.

At 2:10, the male is trying to kick the downed female in the head. The cop had to make a split-second decision.  Ma'Khia Bryant was hardly a petite teenager.  She looked big enough to play offensive center for a professional U.S. football team. Maybe at least the girl in pink is glad the cop fired his gun.

The Internet is already awash with rumors with different versions of who called 911 and why.  Some reports say Ma'Khia lived in a foster home and got into a dispute with other residents, but nothing is very clear at this point.

The message seems clear to me:  White cops shouldn't intervene when a Black is trying to stab another Black.  Let them kill each other.

The Cop is a good shot. As you know it's not easy to be super accurate with a handgun especially in a moving situation.

Good thing the shots the cop fired didn't nail someone on the other side of the freeway, though.

Possibly better to let the perp go and catch him down the road? Tough call considering the perp already shot at the cop.

Living in the Bay Area requires heightened 'situational awareness' as there's lots of bad guys running around with guns these days. Don't want to get caught in the crossfire.

Derek Chauvin's sentence will be announced in eight weeks.  The judge will order a pre-sentencing report for the most serious charge, which is normal practice in the U.S.  The prosecution has asked for enhancements to sentencing based on two aggravating factors: 1) a police officer abusing his authority; and 2) committing a violent crime in front of children.  Chauvin waived his right to have the jury decide on the enhancements;  they will be determined by the trial judge along with the sentence.  

The maximum penalty for second-degree murder is 40 years in Minnesota, but 12.5 years is what is usually given for offenders without a criminal record.  The enhancements could add another five to seven years.

However, the judge is free to impose a much longer sentence.  He could also impose consecutive sentences, rather than concurrent, on all three charges.  That could potentially put Chauvin behind bars for a maximum of 75 years, but that is very unlikely as Minnesota has a law against what's called "double punishment," i.e., imposing numerous consecutive sentences to keep an offender in prison the rest of his life.  To spend the rest of his life behind bars, an offender in Minnesota has to be convicted of a crime that carries a life sentence with or without parole.

Judge Cahill will of course be very aware that announcing anything less than the maximum sentence will almost certainly touch off massive rioting.  He could impose the maximum, knowing full well the sentence will be appealed.  After Chauvin has spent 10 or 15 years behind bars, an appellate court could find the original sentence too severe and order Chauvin's release.  It's a slick way of diffusing the situation and Chauvin doesn't really lose anything because he'd be spending those 10-15 years in prison even if he'd gotten the lightest sentence.

She was a POS with no regard for the other girls life, the male that kicked the girl in the head should be charged as well, she could have ended up with serious brain damage.  very good judgement by the police officer, in a split second he saved the girl in pinks' life as she would have received a knife wound to the throat.

This is what happens when you live the "thug life"  of drugs and violence, the cops are the first ones to be called  on when shit goes down but the perps can't deal with the reality of what might happen. If these people just complied and didn't act the smartarse then their lives could have been saved. Just lay down and go through the process. If you think you were unfairly dealt with then pursue it in court.

Don't see any of these people volunteering to keep their community safe but they want to condemn the very people who do (police).  There are some very good officers out there that save lives everyday but you don't really get to see that. 

 

No doubt the social engineers will portray  this POS Makhia as a straight A student  that loves puppies and kittens rather than the hood life that she chose to live. They will turn it into a black and white issue and as before, we'll have the likes of congresswoman Maxine Waters call for people to "step up" the violence , burning and looting ( even against their own) .  Maxine should be indicted for inciting violence and unrest in the community, while there are people like her around there will be no peace.  These social manipulators  are the ones oppressing the working class for their  own gains 

I could go on but it makes my blood boil when I see hard working innocent people suffer in these riots.

They are not all pricks who draw their guns right away. Saw one poor bugger who just lost his life in New Mexico, he chose to speak nicely, from the passenger side to a guy in a truck with an AR-15 or similar. Just when you hear him ask for the weapon to please be in plain view, and the killer to step out, guy grabbed the rifle, got out,  and fired over the truck, then finished off the cop execution style. 
 

Now I know why these guys are on edge, they never know if this could be their last day on Earth. This cop was way too patient with the offender, especially having no partner to back him up. And his 4th kid is on the way.....poor family. But CNN won’t broadcast this story I guess

The truth about Duante Wright. The 20 year Grade A student who loved him momma and his puppies and painting ceramics ........... not quite. I had heard he was a wannabe gangsta thug but searched in vain for it on the media BBC etc.

This Officer Tatum podcast is a great way to spend 15 minutes talks such common sense cannot recommend it enough.

Subscribed! Holy cow, this man is great to listen to. Almost made it to the NFL, his great uncle was actually Jack Tatum, who was a killer defensive back, turned one guy into a quadriplegic with a ferocious hit(highly illegal by today’s standards)

Chauvin never drew a gun either, yet his victim ended up dead all the same.

Floyd did not die because he had a large heart, as the defense claimed. He died because Chauvin had a small heart. Enough said.
